Please read these Terms and Conditions ("Terms") carefully before using the DogDayz mobile and web application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App. These Terms should be read together with our Privacy Policy (mydayz.co/legal/privacy) and our Disclaimer (mydayz.co/legal/disclaimer), which form part of your agreement with us.
1. About Us
The App ("DogDayz") is operated by MyDayz ("we", "us", or "our"), a business operated by a sole trader based in the United Kingdom. Our contact email is legal@mydayz.co. Our trading/contact address is: 82A James Carter Road, Mildenhall, IP28 7DE, United Kingdom. If MyDayz later incorporates as a limited company, we will update these details (including our registered office and company number) here.
2. Acceptance of Terms
By accessing or using the App, you confirm that: you are at least 18 years old (or the applicable age of majority in your jurisdiction), or have the consent of a parent or legal guardian; you have the legal capacity to enter into a binding agreement; you accept these Terms in full; and you will comply with all applicable laws and regulations.
3. Changes to These Terms
We may revise these Terms at any time. We will notify you of material changes via in-app notification or by updating the "Last updated" date. Your continued use of the App constitutes acceptance of revised Terms. We also increment the internal consent version so existing users are re-prompted on material changes.
4. Licence to Use the App
4.1 Grant of Licence Subject to these Terms and payment of applicable Subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on devices you own or control, solely for personal, non-commercial pet-care tracking purposes.
4.2 Restrictions You must not: copy, modify, distribute, sell, or lease any part of the App; reverse-engineer or decompile it except as permitted by law; use it for commercial purposes; remove proprietary notices; overburden its servers; or attempt unauthorised access to any part of the App.
4.3 Updates We may release updates, patches, and new versions of the App from time to time to add or change features, fix problems, and maintain security and compatibility. Some updates may be necessary for the App to keep working or to stay secure, and we may stop supporting older versions. Where your device or app store is set to update automatically, updates may install without further notice; otherwise you are responsible for installing available updates.
5. Subscriptions and Billing
5.1 Subscription Fees Full use of the App requires a valid recurring monthly Subscription. Premium cloud features — such as cloud synchronisation, multi-device login, and secure backup — are included with your Subscription as and when they become available. Current pricing is displayed on mydayz.co at the time of purchase and is inclusive of any applicable statutory taxes.
5.2 Free Trial We may offer a 7-day free trial to new users. If you do not cancel before the trial ends, your account will be charged the monthly Subscription fee automatically. Free trials are for new users only and are limited to one per person, household, and payment method. We may withdraw or change trial offers, and may refuse or end a trial where we reasonably suspect abuse.
5.3 Auto-Renewal — Important Notice (All Users) YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL. You will be charged the then-current Subscription fee on each renewal date. To cancel, visit your account settings at mydayz.co before the renewal date. We will send you a reminder email before each renewal. You can cancel at any time; access continues until the end of your paid period.
5.4 Auto-Renewal Disclosure (US Residents — California, New York, Illinois) In accordance with applicable state automatic-renewal laws: (a) the subscription will automatically renew at the end of the billing period; (b) the charge will be made to the payment method on file; (c) you may cancel at any time via your account settings at mydayz.co; and (d) we will provide advance notice of any material change to the subscription price. Cancellation takes effect at the end of the current billing period.
5.5 Platform Processing Subscriptions are sold exclusively through mydayz.co and processed securely via Stripe. We do not process payment card data directly. There are no in-app purchases; all billing is managed through your MyDayz account.
5.6 Cancellation and Refunds You may cancel at any time through your account settings at mydayz.co. Upon cancellation, access continues until the end of the current paid period. All fees are non-refundable except where required by applicable mandatory law (see sections 5.7 and 5.8 below).
5.7 EU and UK Consumer Right of Withdrawal If you are an EU or UK consumer, you ordinarily have a 14-day right of withdrawal from digital service contracts under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013. By starting your free trial, you expressly request that the service begin immediately and acknowledge that you lose your right of withdrawal once the service has fully begun. If you withdraw within the 14-day period before the service has fully begun, we will refund any amounts paid on a pro-rata basis.
5.8 Australian Consumer Guarantees Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other non-excludable applicable law. To the extent permitted by the ACL, our liability for failure to comply with a consumer guarantee is limited to re-supplying the services or paying the cost of having them re-supplied.
5.9 Price Changes We may change Subscription fees from time to time. For all users, we will give at least 30 days' advance notice of any price increase, by email and/or in-app. The new price applies from your next renewal after the notice period. If you do not accept the new price you may cancel before it takes effect, and your access will continue until the end of your current paid period. The notice in section 5.4 applies in addition for affected US residents.
6. User Responsibilities
6.1 Accuracy of Information You are solely responsible for the accuracy and completeness of all information you enter. We do not verify user-entered data.
6.2 Pet Care Decisions All decisions regarding your pet's health, welfare, and medical treatment are yours alone. The App is a tracking tool only — not a substitute for professional veterinary advice.
6.3 Account Security You are responsible for maintaining the confidentiality of your credentials. Notify us immediately at legal@mydayz.co of any unauthorised account access.
6.4 Your Account and Deletion You may hold one account and must keep your account details accurate and current. You may delete your account at any time from your account settings or by emailing legal@mydayz.co. On deletion, we erase or anonymise your personal data as described in our Privacy Policy, including its retention schedule; you also have data access, portability, and erasure rights as set out there. We may suspend, restrict, or close accounts that remain inactive for an extended period, or that breach these Terms, giving reasonable notice where practical.
6.5 Your Device You are responsible for using a compatible, supported device and for keeping its operating system, the App, and your security settings (such as a passcode or screen lock) up to date. We are not responsible for problems caused by unsupported, modified ("jailbroken" or "rooted"), or insecure devices.
7. Notifications and Reminders
The App provides reminders on a best-effort basis. WE DO NOT GUARANTEE TIMELY DELIVERY OF ANY NOTIFICATION. YOU MUST NOT RELY SOLELY ON THE APP TO ADMINISTER MEDICATION OR CARRY OUT ANY TIME-CRITICAL PET CARE. THE APP IS NOT INTENDED FOR EMERGENCY, LIFE-SAFETY, OR LIFE-CRITICAL USE — IN AN EMERGENCY, CONTACT YOUR VETERINARIAN OR AN EMERGENCY SERVICE DIRECTLY. Delivery of notifications also depends on your device settings, operating-system permissions, and connectivity (see our Disclaimer).
8. Intellectual Property
8.1 Our Rights All intellectual property rights in and to the App — including its software, source code, design, "look and feel", user interface, graphics, illustrations, the "DogDayz" and "MyDayz" names, logos and branding, and all text and other content we provide (excluding your own content) — are owned by or licensed to MyDayz and are protected by copyright, trade mark, database and other intellectual property laws worldwide. All rights not expressly granted to you are reserved. You are granted no right to use our names, logos, or branding without our prior written permission.
8.2 Enforcement of Our Rights We actively reserve, and will enforce, our intellectual property rights to the fullest extent permitted by law. Unauthorised copying, reproduction, distribution, modification, reverse engineering, scraping, framing, or other misuse of the App or our content is strictly prohibited, and we may pursue all available remedies, including injunctive relief, account termination, and claims for damages and costs.
8.3 Your Content Content you submit (for example pet details, records, and photographs) remains your property. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, back up, reproduce, and process that content solely to operate and provide the App's features to you and to sync it across your devices. This licence ends when you delete the content or your account, except for copies retained as required by law or held temporarily in routine backups (which are purged as described in our Privacy Policy). You confirm you have all rights necessary to submit your content and that it does not infringe the rights of any third party.
9. Disclaimers and Limitation of Liability
9.1 "As Is" Basis THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
9.2 No Veterinary Advice NOTHING IN THE APP CONSTITUTES VETERINARY, MEDICAL, OR PROFESSIONAL ADVICE. CONTENT IS FOR ORGANISATIONAL PURPOSES ONLY.
9.3 Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYDAYZ SHALL NOT BE LIABLE FOR: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or goodwill; harm, injury, illness, or death of your pet; failure or delay of notifications; loss or corruption of user data; or unauthorised access to your data.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR £50, WHICHEVER IS GREATER. Nothing excludes liability for death or personal injury from our negligence, fraud, or any liability that cannot lawfully be excluded.
9.4 US Residents — Arbitration and Class Action Waiver FOR USERS IN THE UNITED STATES: Any dispute arising out of or relating to these Terms or the App will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, not in court. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. This clause does not apply to IP claims, small claims court actions, or injunctive relief. You may opt out within 30 days of first using the App by emailing legal@mydayz.co with "Arbitration Opt-Out" in the subject line.
10. Indemnification
You agree to indemnify and hold harmless MyDayz and its officers, employees, and agents from claims arising out of your use of the App, breach of these Terms, or violation of any third-party rights.
11. Third-Party Services
The App integrates with or relies on third-party services, including Stripe (payments), cloud infrastructure and hosting providers, mapping and location services (for optional walk tracking), and your device's photo library, notification, and platform services. Crash reporting or analytics may be used where enabled. Each third-party service is governed by its own terms and privacy practices, and we are not responsible for those practices. How we handle data through these services is described in our Privacy Policy.
12. Termination
We may suspend or terminate your access if you breach these Terms or we discontinue the App. Sections 8, 9, 10, 13, 14, 16, and 17 survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer-protection rights you have in your country of residence. Any dispute (other than those subject to section 9.4 for US users) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. EU residents may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. General
These Terms, together with our Privacy Policy (mydayz.co/legal/privacy) and our Disclaimer (mydayz.co/legal/disclaimer) — each a separate document that forms part of your agreement with us — constitute the entire agreement between you and MyDayz regarding the App. If any provision is unenforceable, the remainder continues in effect. No failure or delay by us in exercising any right under these Terms operates as a waiver of that right, and no single or partial exercise of any right prevents any further exercise of it or of any other right. You may not assign your rights; we may assign ours to any successor. Questions: legal@mydayz.co.
15. Force Majeure
We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including (without limitation) acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes or other labour disputes, failure of utilities or telecommunications, internet or hosting-provider outages, cyber-attacks, or government action. Our affected obligations are suspended for the duration of the event. Nothing in this clause limits the statutory rights of consumers.
16. Copyright and Content Complaints
We respect intellectual property rights and require users to do the same. If you believe content in or made available through the App infringes your copyright or other rights, send a notice to legal@mydayz.co including: (a) your name and contact details; (b) identification of the work or right concerned and of the allegedly infringing material; (c) a statement that you have a good-faith belief the use is not authorised by the rights holder, its agent, or the law; and (d) a statement that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf. We will review valid notices, remove or disable access to infringing material where appropriate, and may suspend or terminate the accounts of repeat infringers. This procedure is intended to be consistent with the safe-harbour requirements of the US Digital Millennium Copyright Act (DMCA) and equivalent laws in other jurisdictions.
17. Acceptable Use
You must use the App lawfully and responsibly. In addition to the licence restrictions in section 4.2, you must not: upload, store, or share content that is unlawful, infringing, defamatory, obscene, or harmful, or that you do not have the right to provide; harass, threaten, abuse, or impersonate any person, or misuse the App in relation to the welfare or treatment of any animal; use the App to facilitate or promote any illegal activity; scrape, crawl, harvest, or data-mine the App or its content, or use the App, its content, or other users' content to develop or train any machine-learning or artificial-intelligence model; introduce malware, attempt to gain unauthorised access, or disrupt or place an unreasonable load on the App or its infrastructure; or resell, sublicense, or commercially exploit the App or any content without our prior written permission. We may remove content and suspend or terminate accounts that we reasonably consider to breach this section. To report content, use the process in section 16.
18. Early Access and Beta Features
Parts of the App, or the App as a whole, may be offered as a preview, "early access", or "beta" release. These features are provided "as is", may be incomplete, may change or be withdrawn at any time, and may be less stable than general-release features. We may use any feedback you give us about them without restriction. Sections 7 (Notifications and Reminders) and 9 (Disclaimers and Limitation of Liability) apply with particular force to early-access and beta features.
